What is SB 553?

On September 30, 2023, California Senate Bill 553 was signed into law and California Labor Code section 6401.9 was enacted on July 1, 2024. Affected employers must establish, implement, and maintain an effective written Workplace Violence Prevention Plan to be compliance.

 

Who Needs a Workplace Violence Prevention Plan?

The WVPP requirement applies to all California employers unless they are specifically exempted. The exemptions include:

  • Employers already covered by the WVPP in Healthcare standard (or employers that already comply with that standard)
  • Facilities operated by the California Department of Corrections and Rehabilitation and law enforcement agencies
  • Employees teleworking from a location of their choice that is not under the control of the employer

Places of employment that are not accessible to the public and have less than 10 employees working at any given time, so long as they have a compliant IIPP.

What’s Required in my California Workplace Violence Prevention Plan?

Workplace Violence Preven Plan requirements can be broken down into 7 parts:

  1. Creating your written plan
  2. Employee (and union, if applicable) involvement in the plan
  3. Scheduling periodic inspections and hazard correction
  4. Scheduling periodic employee safety meetings
  5. Investigating workplace violence incidents
  6. Conducting annual (or more frequent) employee training
  7. Recordkeeping requirements, including a violent incident log
