In California, all employers have workplace posting obligations. Between the state and federal requirements, California employers must post a total of 18 state and federal employment law notices.
These requirements can and do change! It's January and time to meet your 2019 posting obligations.
Here are some answers to common questions we receive.
Q. Are there new mandatory poster changes for 2019?
A. Yes. For 2019, there is:
- A mandatory update to the required California Minimum Wage notice
- A mandatory update to the required DFEH Discrimination and Harassment posting
- Other mandatory changes this year include an update to the required California EDD Notice to Employees
There are also recommended changes to other postings.
Q. Do I need more than one poster?
A. It depends. Employers will need to post the poster in each location where the company has employees, e.g., offices, stores, warehouses, branches, etc.
Q. Where should I hang the poster?
A. You need to display your poster in a location where all employees can easily see and read it; e.g. breakroom, hallway, kitchen, copier room.
Q. Do I need posters in other languages?
A. Depending on the poster involved you may need to post in other languages. For instance, California’s Department of Fair Employment and Housing requires that if 10% or more of a company’s workforce speaks a language other than English, the posters must also be displayed in that language (or languages).
And the California Department of Industrial Relations requires employers with workers who speak and read only Spanish to post the minimum wage notice in Spanish.
Q. Are there fines for not posting?
A. Yes! Failure to keep updated posters can result in employment fines. For instance, failing to post the mandatory workplace safety poster can result in fines of up to nearly $13,000.
